Kathrin Asschenfeldt is a very experienced arbitration and litigation practitioner. She acts as counsel in international arbitration and state court litigation proceedings. Kathrin advises clients on disputes in all areas of commercial law, often in cross-border matters. She has particular expertise in corporate disputes, post-M&A proceedings, D&O liability cases, and disputes regarding real estate and financial transactions. She is also experienced in negotiating and litigating large-volume contracts with technical backgrounds. Moreover, her work concerns maritime-related disputes, sanctions, and antitrust damage claims.
In addition to her work as counsel, Kathrin sits as arbitration in international arbitration proceedings (sole arbitrator, party-appointed arbitrator and presiding arbitrator).
Kathrin has 15 years of work experience from both working for a major international law firm and as an in-house counsel. Before joining BAUMANN Resolving Disputes, she was a counsel for Freshfields Bruckhaus Deringer’s Dispute Resolution practice group in Hamburg where she worked for more than 10 years. Subsequently, she worked in Singapore as General Counsel for the Schulte Group, an international shipping company. In August 2022, Kathrin joined BAUMANN Resolving Disputes as a partner.
Kathrin Asschenfeldt is recognized by Handelsblatt / Best Lawyers among Germany’s Best Lawyers for Arbitration & Mediation, International Arbitration and Litigation. Wirtschaftswoche 2022 and Leaders League 2023 list Kathrin as a “highly recommended lawyer” for international arbitration. - Advising a large real estate company with regard to claims for damages against tax advisors for breaches of duty arising from their advisory activities.
- Advising a US IT company in connection with outstanding payments and claims for damages under a software supply agreement.
- Strategic advice on the assertion of cartel damages claims for a large number of plaintiffs against several cartelists.
- Advising a distribution company regarding claims in the event of a delivery stop by a supplier.
- Defence of an international automotive supplier against an action for payment following the completion of a M&A transaction based on an exemption clause for antitrust issues (DIS arbitration proceedings) *
- Representing a major financial institution in ad hoc arbitration proceedings against former board members in relation to claims for damages for breach of duty in connection with the conclusion of complex financial transactions. Parallel negotiation of a settlement with a consortium of international D&O insurers. *
- Presiding arbitrator in a DIS arbitration concerning claims for breach of warranty under an SPA (Post M&A).
